I have change my name for this one!My dp is currently going through mediation with his soon to be ex. She lives in the family home with one of the children and her partner, the older children verify this. She is claiming that he doesn't live with her for the divorce. It turns out that she is claiming family tax credits, presumably not declaring that he lives there too. Do any of you know is this legal?

Well that makes it about £150 per month less than she gets now, no wonder she diddn't persue it.

Double check that with them and maybe get them involved?
If she is claiming benefit, income support jobseekers or whatever she wont get much of the maintenance through the csa.
But if shes working part time, not declaring her partner whos living with hers income and getting maintenence then she will be much better off.
Which is exactly what my dps X does BTW.
