Is he right??

DH and I have been married 10 years. He has two houses both in his names. One is rented out the other is our marital home. If we got divorced (because he's been an arsehole....) what are my claims/rights on those properties? Do they fall into one big pot or are they effectively his?

He is saying that putting them into joint names wouldn't make any difference to me. Is he right?

No, it wouldn't really. In the case of divorce all the assets go in one pot and can be divided at the discretion of the court. There is no 'mine' and 'yours' in marriage.

I'd say he's right putting them into joint names makes no difference as you are entitled to 50% of all assets whoevers name they are in I think

which is probably not quite what he means

personally I'd see a solicitor and ask

I'm pretty sure that the courts seek to restore both parties to the position they were in prior to marriage. So if he owned these houses before he met you this would be taken into account.

If you have a child court will say that you and a child can live in a house until child is 18 at which point it is sold and X husband gets his share of equity.

There is so much free information on web you can find out a lot before paying a solicitor. Do your homework first then ask solicitor specific questions, don't rack up fees unncessarily. Which do a book called Guide to dovorce which is a good starting point.
