WHAT FINANCIAL RIGHTS DO I HAVE IF WE SPLIT?

Possible marriage split ahead. We own our own house and business, both of which are in joint names. I've heard that if I move out, I lose some financial rights with regards to the house.... does anyone know if this is true? Does this apply even if everything is in joint names?

make an appointment at the CAB - ask them to go through the basics with you. And maybe you will need to see a solicitor as well. But a place to start anyway.

When my DP got divorced after his ex-wife had voluntarily moved out of the house and taken their daughter (to live with his ex best friend who he used to work with but that's another story...) it certainly didn't affect her rights to anything - their joint house/his pensions/their joint endowment policy/his shares etc.

Was also told by my solicitor that even if I did move out with children I would not lose any rights re the house (in joint names). See a solicitor as soon as you can just to put your mind at ease.

There are two ways to own a house jointly.

If you are joint tenants which most husbands and wifes are then everything is owned jointly. If one of you dies the other gets the whole house and conversely if you split up then it is split 50/50.

If you are tenant in common then it will say in the deeds the equity split - 50/50, 80/20 etc... This is normally done if two friends buy a property and put in unequal amounts of deposit.
