Bailiff coming at 7pm - what are the legal ins and outs??

One turned up earlier today but I didn't answer the door.He left a letter saying it was for council tax from our old house which dp is one month late with.
The letter says 'unless you contact the bailiff within the next 3 days we will return with a view to levy distress on your goods blah blah blah.

So, dp called them right away. He is a month late with a payment of 100.00, the letter says today's visit fee is 22.50. The bailiff is demanding 150.00 tonight or is taking our stuff.

Can he do it that quick? dp offered him 50.00 today and the rest on Friday but he said no, 150.00 tonight and that's it. But if we had waited the 3 days to ring him we could have paid it all on Friday!

Is he in the right to do it this way or can we make an offer of payment until Friday?

I'm going to ring the police and see what they say. I just wish dp would hurry up and come home then I wouldn't feel so worried. The kids are screaming for their dinner and poorly as well which isn't helping!!

I know its a complete invasion of privacy but i would seriously consider looking up Steve Roberts/Theresa Stanton's details on 192.com (under director reports) - if someone has a couple of spare credits it would be helpful. Then telephone either/or at home and explain te prob. If its not legit - they'll be on your side and if it is then I wouldnt worry about contacting them at home given that their personal info is freely available

Have been on the phone to the police - who went through the bailiff laws with me which were pretty much what was said here except that they can come in any door or window which is unlocked !!

She took my name and address and has said there is nothing coming up - ie can't see that anyone would be coming but to only look through the window and don't open the door unless he really has the police there. She said she has logged it as an incident and if anything happens with him and dp to come straight back to her and she'll sort it Feel a bit safer now!! Thanks for all the advice and for giving me someone to talk to in my panic!!!

the unlocked door or window is because they can enter but not force entry

Good Luck zephyr.
Just lock all your doors and windows, draw the curtains and dont answer when he knocks.
Let us know what happens.

Just to let you know I have checked there website out and in there FAQS bit it states that they do not force entry to properties.

The police will look after you they hate bailiffs as much as everyone else, just make sure that you complain to the MD of the company first thing tomorrow.

Police will not come and shout at you, they hate drug addicts, not people with debts. They will not let the bailiff intimidate you a lot either, so it would be a good thing if they did get involved.

Hi everyone - the bailiff rang the house and said to 'Tell Mr Myers I'll be seeing him in half hour'

When he came dp spoke to him through the letterbox and I could hear the bloke saying @I can't hear you" so dp went upstairs and shouted from the window! He told him we'd spoken to the police and then he came down saying he'd accept 50.00 but he wants us to open the door. So dp got 50quid and went out the back and around the front and has been out there for ages on the blokes phone - I assume to his boss.....

I am so angry at the way he tried (and succeeded!) to scare us into letting him in and the company will def be hearing from me in the morning.

Just keeping one eye on dp in the meantime to make sure he doesn't end up arrested or something!!

Damn nasty pig, you should tell his boss in the morning that you have been seeking advise all afternoon because you felt so threatened and that after you attempted several times to make an agreement for payment with the bailiff you had no choice but to report him to the police and that you will be happy to get a copy of the police log and send it for there records so they can see just how scared you where.

I can just see out the curtain. Bloody hell he's huge! lol he's lecturing dp from what i can see. Lots of hand gestures going on...
THey are both standing at the gate looking at the road. God I hope this twat hasn't actually called the police. If I disappear soon they've got my pc!!!

He would rather come in and seize goods than accept half now and half tommorow.

I'm aware that it's our fault for being late but this is the first we've heard. My point is I'm angry that he has just turned up demanding 150.00 or our stuff. I thought there was meant to be a procedure to it, not just blatant nastiness.

still outside!! They've gone over to the road now as our house is set back - the bailiff is writing something out so dp is making him use the grit bin to lean on
