who will have to repay this?

got a letter from tax credits saying there was an over payment in mine and EXp's claim last year. the thing is, we separated in august and i have still to put in my claim as a single parent. will they take the over payment back from my claim or will EXP have to pay half of it back from his own money?

You will each be liable to repay 50% of the overpayment. You should get your single claim in as soon as possible as they only backdate 3 months. You may be eligible for something called Notional Offset (they will offset the amount you would have been due on a single claim against the overpayment). Because the single and joint claim are seperate they will not collect the overpayment by reducing your single claim - you will be asked to pay the overpayment directly.
