okay...a woman RAN in front of my car...now 10 days later, she wants to claim??

i dont know if any of you remember my thread about a woman running in front of my car?

i was coming off hospital car park, and she ran directly in front of car, i hit her (quite hard) and she landed 10 ft away on car park...i was hysterical, so was dd, the woman fractured her leg and totally admitted liability in front of me, my friend, 2 paramedics, 2 a&e nurses...

well 10 days later (today) i had a call from the police to say she wants to put a claim in against me!! cant believe it!!

no one actually saw the accident apart from me and my friend, but surely because she took full blame (she said she was running for her bus!) she hasnt got a claim iykwim...

TIA for any advice...really need it xxx

hmm well really you need to track down the witnesses to her admitting liability

Mare! get solicitor on case, explain witnesses to them and I reckon they should be able to get statements off all of them to make her claim nul and void, {{{Hugs}}} hope its all over soon.

I shoulda killed the silly cow, now she wants to sue!

I reckon the fact that you have got others who heard her admit it was her fault that she has no case

i have contacted A&E, i have the 2 A&E nurses names, i have to phone on monday for the paramedics though.

i put in a claim against a lorry driver who drove over the front of my car. at 1st the insurence company denied liability but as the guy admitted to the cops they rae having to pay out.

but wont your insurence company deal with it all?

exactly starlover! obviously someone or herself has though...oohh claim some compo! GRRRRR.

the insurance co (admiral) will deal with it, may claim right back at her for trauma, and trauma for dd...oh and the dent on my car

i felt sorry for her, didnt dream she would claim against me, but should have expected it really, just cant believe it...after she saw how upset i was and said "dont get upset hun, it was totally my fault, i was tunning for my bus!"

oh god, i was insured with admiral and they were AWFUL when someone ran into me. ended up with nothing

Bet she's just seen a TV ad for some accident claim company and thought she'd try it on.

Sounds like you have witnesses and the time delay on your side though - plus the fact you didn't do anything wrong!

You don't live in Coventry do you, I saw a woman the other day in the solicitors that got knocked over in a hospital car park and was wanting to see if she could make a claim. She had a bruised shoulder, head injury and broken leg.

i saw an episode of judge judy where some woman claimed for the dent in her car after she hit a guy who ran infront of her. she won, but then that is america

Definitely get a solicitor.

If it's any consolation though, when a lorry ignored a give way sign and plowed into the back of me, he cunningly apologised and admitted liability to me in front of a couple of police officers (he crashed into me not far from Croydon police station!) Took bloomin' ages to sort out, but insurance companies ruled in my favour eventually.

OK when i was 16 i ran in front of a car.... gor tun over, was hit at 50mph (survived ) and then sued the driver (in civil courts) and won... (saying that speed limit was 30mph so he was in the wrong, but police did not prosecute him, (no fine no points nothingh (IF i had dies he would have been charge with death by dangerouse driving tho!)

i wouldnt worry... i assume you are insured... she can only go through civil courts and if / what she wins your insurance will have to pay out any way

Did you report the accident to the police at the time of the accident?
Have you notified your insurance company that you were involved in an accident?
Get on the phone to your insurance company asap. They will provide you with a solicitor.
You should have reported the accident to the police as someone was injured. It is an offence not to do so....but you probably dont want to hear that

Hope it all works out for you and Im sure as you have reputable witnesses, that will confirm that it was not your fault, you will be OK.

it is possible her lawyer will argue that you should have been taking more care whilst driving (not my thoughts but you know). Usually people lie to their lawyer/claims co about various things and in this case i bet she hasnt told them she has admitted full liability. They may seek to settle on a 50/50 split (or similar) or apportion a degree of contributory negligence on her part. Either way, it is sometimes more economical for the insurance company to settle out of court and agree liability with another party to save costs. By the way, I dont htink you can counterclaim for trauma etc

TBH the delay in claiming may have been anything - getting over the shock, dealing with injuries, seeking advice etc. 10 days is not too long but I think if she admitted liability she shouldn't have raised it again.

agree with skinnycow.

you can claim for up to 3 years for personal injury; in that context 10 days won't be seen as very much at all.

unless you have received physical injuries, you can only claim for trauma if it is serious enough to result in a recognised psychiatric illness.

DH had an accident on Oct 1 last year. He was waiting to turn right out of the top of our road and this woman came belting round the corner. The front of his car clipped the back of hers, she went out of control and spun off the road 20 metres down a bank. The police came and told DH "she hit you" (his car hadn't crossed the white line). The witness said "she was driving far too fast". (60-70mph on a 30mph road)

Then her husband and her brothers turned up (built like 3 brick sh*thouses) and were all very pally with the witness. The police kept us away from her and the witness and we couldn't hear what was said.

When we got the stuff through from the insurance company it was recorded that the accident happened 20 metres from the junction ie he pulled out behind her (left) and hit her up the back. (That would mean his car was capable of an acceleration it just can't do from a standing start). He rang to complain and was told "that's what the police said". The police then threatened him with prosecution. Instead he had to pay £85 to go on a safe drivers course. There he met a whole load of other people who hadn't actually been at fault for what they were sent for including one poor bloke who had been charged because he was driving too slowly on a narrow country road in Scotland and apparently blocking someone's way! The police told him the same bloke had complained about 3 other people too, and they all got prosecuted.

Anyway this week DH got a letter from this woman's insurance company claiming compensation for injury. Apparently following the accident she wasn't even able to look after her dog and her husband had to do it! He rang his insurance company and they said it was ok, they were d/w it and to ignore it. He told them again that it wasn't his fault and they said "we know". They said it is well known that the police lie to fit in with what they want to happen. (That really shocked me)

Sorry, this was a very long-winded way of saying that even if it was totally her fault, the crap system we have will probably find you liable because it seems to reward whoever tells the most lies (Can you tell I'm bitter and twisted?!)
