oops, just phoned ACAS, who are saying that it's 4 weeks entitlement (pro rata), regardless of how few hours they work. Does that sound right? Means our admin person has been deprived of her legal entitlement (not my fault).

you cant discriminate against part time workers so yes that would hold up. If she works 2 hours a week then she is entitled to 4 x 2 hours off per year (i think you can include bank holidays in the statutory entitle, ent

What about if everybody only works 37-38 weeks per year (this is for the preschool). Seems awfully generouts that they get 4 weeks holiday for only 38 weeks work, anyway.

I work term time only 8 hours a week (39 weeks) I have 4 weeks paid holiday (well 4 x 8 hours) and am not paid for the other 9 weeks of the year.

sparlover · 16/09/2005 10:50

but the 4 weeks holiday is pro rata.
they don't get literally 4 weeks off. (ie 20 days)

i don't really know how the system works but would assume that if they do an hours work a week then they would get 4 hours holiday

that is about what I worked out, Potty1.
Can't believe I have to become expert in employment law now, too, to be chair on the preschool commitee.

I am pretty sure for a 52 week period you get 4 weeks paid holiday minimum. If you work any less hours than full time, and any less weeks you work it out pro-rata.

so 38 weeks would be 73% of 52 weeks, and 2 days per week for that would be 2/5 0.73 20 days = nearly 6 full days holiday per year.

At least that is the way my holiday is worked out for part-time work.
