i would have thought they would ahve paid it back automatically if it was wrong

or when he works again they might?

Phone up his tax office - if he has any payslips it should show which tax office, otherwise just go here hmrc tax offices and it will find your tax office for you. Phone them up. And yes, start looking for those bits of paper now, or at the very least his final payslip.

It isn't automatic , so he may need to submit a tax return, call his tax office and ask for a form - I'm afraid he'd need a P45 form from his employer (or P60) stating how much he recieved and and paid tax on, plus to declare all other income received during 2009-10 .

Quite often the benefits office make the refund if you are claiming at the end of the year. They should have given him a P60(U). He won't have had a P60 from his job as you only get one if you are working at the end of the year.

If you can't find the P60(U) contact the tax office, tell them where he was working and when he finished, and what benefit he was claiming. He may have to wait a while if they need to contact the benefits office but if he has overpaid he would then get it back.

If you have a Tax Enquiry Office in your town pop in there and you can speak face to face with a tax officer. If you know your partners NI number, that can be the starting point.

Claiming Back Overpaid Tax

There's a huge amount of information here on claiming back overpaid tax and I'm sure you'll find the section that is most relevant to your particular situation. (How to reclaim PAYE payments - previous years)

i claimed some back this year from 2 years ago. I did have my p45 but when I rang up they never asked for it.

juneybean · 30/10/2010 10:42

I did this for last year, I was asked to write a letter to my tax office with copies of P60's and P45's from the tax year.

Got a hefty bit back ...but then they took some off me for the year before haha

I just phoned them up and said I had overpaid, didn't need to send them any p45s or p60s. Got a cheque in the post a few weeks later.
