Child support, will it be back dated?

Ex p has never paid child support, but has always bought things for dd instead and kept the recipts as proof.

If he gets access to see dd through the courts will he then also have to pay maintence? Also would he have to pay back dated maintence? Or will they just be happy with him buying her things and keeping the recipts, even though some of the stuff he bought was rubbish that she didn need or that didn't fit her.

even if he is not seeing dd he should be paying maintenance, the two are not linked. you can decide between the two of you what happens. if he is unwilling to give you money each week or month (about 15% of his wage i think) then you should make an application to the CSA. The court's will not deal with maintenance for dd

Ok great thanks, its just that as he buys her thngs I think he feels it is ok not to pay maintence.

Have you told him you'd prefer cash instead of buying things? Or said what you would like him to buy if you're happy with this? Is he spending the same sort of money he'd be liable for in maintanence?

is it worth emailing him a list of things your dd does need? It could be under the guise of helping his family out to buy things they know will get used?

We do this for dh's family as they don;t directly contact us but insist on asking MIL what our ds's need. We put a range of things, clothes (with specific sizes) characters they are into, styles (ds 1 into camoflage) also toys they like, books etc.

Yes this is mainly for birthdays/christmas but it does mean that the ds's get stuff bought for them they need and will like.

Sorry can't help on the maintenance, just though this may help the current situation

Yes I have told him quite a few times before that I would prefer for him to pay maintence instead of buying things for dd, but he will not do that.

Also we are not speaking at the moment so I cannot really email him or tell him what dd needs. I think it would be best if the csa deal with it. And I do not think the things he buys dd = 15% of his salay per month.
