My BIL split from the mother of his child before Christmas. He is now in a new relationship and is living with new GF 250 miles away from old home and his child.

His Ex has decided that he can only have access to said child one weekend in 4 and child is no longer to go to BILs parents house (my in-laws). She'll know if he does and she says there will be trouble if she finds out.

BIL so far accepting of all this, but is beginning to feel he should do something. Where does he stand?

Advice would be good, obv I don't want to meddle, but he's at a loss and needs help to sort the situation out. Am posting here in the hope that someone will be able to offer some unbiased advice.

He needs to get a solicitior if he cant amicably arrange contact and it sounds as if he cant being as SIL thinks she can call the shots. It should be all about what is best for the DC'S not what the SIL wants.... unless there is a very good reason

A lot will depend oh if he has PR, Itake it they were married as you say BIL and SIL ??

Lulumama · 28/03/2009 16:35

he is living a long way away isn;t he? and why did they split? was he with this new woman before the split?

not a lot you can do , nor should you, but recommend he gets legal advice ASAP

mediation is usually a part of divorce proceedings

They were never married.

He wasn't with his new girlfriend properly before the split, they were just friends (how true I don't know). He moved from the south of England when his Ex decided to move there with their child. She's still there, but his family are all here in the south, if that explains the distance?

No solicitor has been involved so far.

tricky one

i think ex SIL will proably be pissed that he was unfaithful, or if not, he is with someone he was friends with when they were still a couple. and therefoer not inclined to be reasonable

how often can he see his child , logisitically, with a 500 mile round trip

he needs a lawyer.
not sure of all the ins and outs re PR etc

I travel 400 miles every two weeks to have contact with my son. It can be done.

The mother of the child is not being very reasonable. The father of the child might try writing to the mother and ask her for reasons about refusing to allow the father to see the child at the child's family. Understanding the mothers issues/problems helps the father look for ways to look for alternatives.
