Quick question

Ex is being a pain. he had agreed a figure for maintance but now is going back on it as he says he is paying for a joint debt ( true) I said that that is nothing to do with child maintence, and will be sorted in the divorce settlement, maybe he pays it and i dont take his pension?? Anyway, he said it is taken into account.

Also, exacally how much should he give me per month?? He earns about £30k.

thansk

It depends on his income after tax so hard to say, if you have a joint debt which he is paying, the CSA will take this into account. The CSA amount is 15% for one child 20% for two and 25% for three. but like I say this is his income after tax, not before.

they do take it into account if it was debt that was taken out for the "benefit" of the family (though their decisions on how they work out whether it is or not seem rather much like flipping a coin......).

I know this because they refused to take into account DH's (we're separated but trying to patch things up now - but still living separetely) debts that's he repaying. because they were taken out to set up a business they apparently weren't for the family (regardless of the fact it was a family business that we both worked on )

I am watching this thread with interest, as xh is trying to cut my maintenance payments saying he cant afford it, but the only reason he cant afford it is because since separation he bought a 20k car which drinks fuel..... He reckons the csa wont make him pay so much cos he has so many outgoings, but I dont think that one will count as he got it after separation?

shelleylou · 23/02/2009 09:18

Ragged that wont be taken into account. No utgoings are aprat from debts that were for the benefit of the family. Only way they will work out he should ay less is beacuse he has the dc's over 52 nights a year or they give him a travelling allowance if there is a distance between you. He can only have one or the other though so dont let him try to scare you with that.

raggedtrouseredphilanthropist · 23/02/2009 10:35

will the travel allowance take into account that 1) he moved further away (I am also moving further away too, but not yet), and that 2) his car DRINKS petrol?

raggedtrouseredphilanthropist · 23/02/2009 10:35

oh yes and 3) we meet halfway to transfer ds over?

shelleylou · 23/02/2009 11:11

im not sure how much it is think its a standard amount for the distance he has to travel. It has to be asked for though dont think they apply that autmatically. It usually a reduction for shared care which is 1/7 a week if he has the dc(s) 52-104 nights a year
