I'm going to see a solicitor tomorrow for advice, what sort of questions should I ask?

Dear all,.

I know what myself and my ex are doing, I am signing the house over and he is buying me out, I have two small children. We have been split up since October but been getting on v well living in the same house until Xmas came and went.

My brother in law and sister are trying to interfere help and my brother in law has offered to pay for his solicitor to see me and get some advice. Basically they want me to stay in the house but I have already made MY MIND up about what i am going to do. however, it won't do any harm to find out what my other options are.

What sort of questions shall I ask her? I need to go with a list apparently. I am sitting here armed with a lined notepad and a blank mind and I see you ladies are so helpful, can you give me a few options?

why are you signing the house over?
you are entitled to stay in the house
where is your ex now?
if she is a good family law solicitor you wont need a list as she will be able to take you thru everything just like mine did

Can only say what asbm has just said - why are you signing house over? I made lots of emptional decisions when we first split and now realise how wrong that was. Go with an open mind and your blank notepad. If sol is good they will tell you. Wouldn't rec jsut signing over house - you with dcs would maybe get house - you can always sell it when house prices go up again. Don't make any decisons till you've spoke to sol and had time to think about it. Don't let emotions/fear/desire to move on quickly cloud you. Good luck.

Sort out finances - if you want him to buy you out that's fine, but what other assets will you be splitting - pensions? savings?
how will you house the children? what maintenance will you be getting from him for the children? will you need spousal maintenance if you are looking after little ones?

go along armed with a basic idea of the value of your assets and debts and your and his income and childcare costs

would also seriously look at mediation
i found it clarified alot of the financial stuff which i was clueless about
