Child maintenance - fees?

Hello, currently don't use CMS - however, I saw something about fees...does anyone know how much they are? I assume, this would come out of the money he pays and I'd just receive e.g. 90% of it?

Dad currently gives me half of what cms state is the guideline. Just looking for some for of guidance to start really?

The fees are only paid if you use the collect and pay.
I think the NRP pays an extra 20% and then they charge you 4%

I think it’s 20% on top of what he should be paying and then you get what he should be paying minus 7%

If he pays the calculation amount directly there are no fees. If he won't pay you directly then you'll both pay fees. I believe this is something like 20% for him as an additional amount and you would lose 4% of what he pays.

If the calculated amount payable was £100 p/wk, then they would charge you 4% so you'd receive £96, and they would charge him 20% so he'd pay £120. So essentially, the amount you receive is deducted a tiny amount, but he gets seriously stung.

I'm certain of the full amount split between 2 kids, dc1 gets 3/4 of it and dc2 gets 1/4 of it. I don't "need" his money but I don't want dc to miss out because he's rubbish.

Are you sure about those %? Are both children yours? Why would one get more than the other?

Not sure. I've seen (over a shoulder) what dc1 gets. Dc2 (is mine) - he privately gives me £80 per month and dc1 (when I last saw was getting nearer £250).

He earns somewhat between £27k and I estimate £30k (maybe more, but I wouldn't like to say).

Cms states 160 to each child provided I've understood it correctly.

CMS will work out what he has to pay for 2 children, and you and the other Mum get half each.

Correct. Only dc2 is mine.

Favouritism.

Dc1 got all of his weekend attention (even when dc2 was born). He only spends time worh dc2 because dc1 decided they didn't want to spend all weekend with him now they were getting older! He'd never have done it on how own.

Hes never had dc2 on his own (he's never expressed an interest) and TBH, I don't want dc2 having to put up with his sharp temper if possible. If this protects dc2 from that, then its what we do (I don't for one minute think he's cause harm - but flying off for no reason isn't acceptable).

Dc1 is 12 and dc2 is 2.

I don't think a solicitor letter with you both signing holds any weight.
If he doesn't pay then you have to go to the cms anyway .....

Cms starts with direct pay - they set the amount & the paying parent pays you. No fees for either side (except the £20 set up fee)
If paying parent then refuses to pay / misses 3 payments / underpays 3+ times then cms can start enforcement action to go to Collect & Pay - where charges are then added on - 20% for paying parent & 4% for receiving parent.

I personally had to use the cms as my ex partner refused to acknowledge child and disappeared off the earth - he's been on cms for 3 years and still haven't heard anything from him - but money has been consistent due to cms - otherwise I am sure he wouldn't be paying anything
