Has anyone had issues trying to close a child maintenance claim? I've requested to close it twice now but it's still not closed?! How long is it suppose to take? I first requested a few months back but case is still active and still getting letters

Why do you want to close it?

CadburyDream · 13/05/2023 10:41

Because there are no payments

Is he not meant to pay anything or doesn’t because I would still leave it open . If he doesn’t pay it can move to direct payments- if he doesn’t owe anything leave it open the check every year

He doesn’t need to pay Cms have confirmed he is exempt

How come?

He's on benefits but has debts so doesn't have to pay. Child maintenance aren't able to take anything from him. His situation hasn't changed in years so not holding my breath! Would rather move on.

I get that . I only get £30 a month for my Ds from ex . I would just leave it there and forget about it .
my D’s is 16 and my ex has remained on benefits the whole of my Ds’s life . Fortunately I am not reliant on the money. I do wonder when it stops will he actually get a job is he keeping himself poor not to pay me but doesn’t see his Ds so will never know

Ah see i would keep it open if there was some payment however small but there is none. I'm not giving him the satisfaction and being on benefits he probably has to pay back his debts at £1 a week so will never be clear. Also as he will likely stay on benefits he won't have to pay back any of the arrears as they can't take arrears from those on benefits so when my children reach 18 the money will just be wiped off the system anyway.

Just because your children turn to adults the debt doesn't clear. Don't close it honestly keep it open you might not be gaining anything but the moment you close it you wipe them debts yourself. You keep the case open they will chase as long as it's standing. Also debts that are taken out of universal credit are priority debts so they won't always be there. Just play the waiting game, you have nothing to lose x

I thought they wrote them off I've heard of people having arrears written off and they wrote off exes arrears once but it was only 1k so I didn't really care

There was a lot of old css debt written off. Three debts can be taken off at once from
Universal credit so when one is paid off hopefully cms will then kick in. I would call them every 6 months. Don't close the case and let him avoid his responsibilities x
