Hi everyone
Just looking for a bit of advice really. My ex husband pays £100 a month child maintenance. He only has DD one night a month. He works full time higher than minimum wage. I contacted CMS as I think his calculations are wrong. But I have checked on my file and my request has been rejected. However when I first put my suspicions to them they originally told me he was earning a lot more and he should have notified them. Now there saying he doesn't have to notify them as it all goes through HMRC and they basically check it once a year! I guess I'm just ranting at how wrong the system can be and surely this calculation is not correct? I sat down with CAB on the phone and he should be paying £170 a month. I don't know what to do? Has anyone else had this?

I feel there must be some mistake. We have 50/50 shared care and even with that, there is an expectation to pay nearly £100 per month....granted earnings are approx £10,000 more than minimum wage (yearly) but with exact split care and the possibility that a claim could even be made to that amount....it doesn't make sense that your ex pays £100 when he doesn't share care of her....I'd see if things could be re-looked into

Thank you both, I know where he works and I know it's above minimum wage. He works full time and I can prove this. Although saying that it wouldn't surprise me if he reduced his hours just to get out of paying C.M.

When you say above MW do you mean 28k, or more like 50k?

He would be earning £10 an hour between 37-40hours a week.

Contact your MP. They seem to have a lot of clout when it comes to checking or rushing CMS, benefits etc
I had trouble with Tax Credits for weeks and was following their bullshit process but he called and they sorted it immediately and apologized.

Ask them again to check HMRC. They know what he is earning. What was on your last review statement. It should tell you what he earns weekly and how they work out your calculations?

Assuming he hasnt done some self employed status. They have all the information.
