Ex trying to use our child’s solicitor to get free legal advice!!!!

Have had to take an enforcement out against my ex. She’s decided to dump her paid for solicitor and self represent but I’ve now received emails from our child’s solicitor (child been made a party and has an appointed guardian) that they’ve had from the ex asking child’s solicitor for free legal advice and asking if she can file her statements etc through our child’s/childs guardians solicitor. Can she do this?? Surely as the sol represents our child it’s a conflict of interest - if my ex wants to be represented or have legal advice doesn’t she need to get independent representation??
Surely it’s like getting a divorce and asking your wife’s/husbands solicitor to help you out!! Bloody bonkers. I represent myself always have done and I file everything to ex and court myself.

I wouldn't believe she could do this ie seeking free legal guidance or advice however, if a person is self representing and there is a solicitor representing another party then the solicitor needs to prepare the bundle for court unless the court decides otherwise. It seems your ex is taking an inch and trying to run the mile.

I would advise the solicitor/guardian that you thank them for passing on emails however shall be making to court aware your ex is acting in a way you deem inappropriate given she's adding to the solicitors day and isn't here client.

Yep as I suspected - I appreciate the solicitor for another party prepares bundle it just seems insane and downright cheeky the ex has asked our child’s solicitor if she can file a court ordered statement through said solicitor (which is paid for by legal aid given that it’s for child!) and asked the child solicitor advice on how to prepare a position statement. There’s a plethora of advice on this online so I don’t see why my ex is incapable of running a quick google search or filing statements herself. She’s intelligent enough - at least that’s what I thought!

As you said, there is enough materials out there regarding LiPs. Having recently been through family court for my DSD and been LiPs, we found there is plenty online as well as reading materials. This book was great for us as their website you can go onto gives you templates for all court documents or bundle making - The Family Court without a Lawyer: A Handbook for Litigants in Person by Lucy Reed. Maybe send her a copy Grin.

LiPs can be successful in family courts - we were although DSD Mum just didn't bother researching, preparing or attempting to prepare/cooperate in the lead up to court.
