Consent order

Hello. Has anyone had a consent order made into a court order? I've come to an agreement with my ex but i do worry a lot. He has changed plans alot in the past and threatened to not return our child. So I would feel happier if our agreement was made into a court order. Has anyone done this? Is it worth it?

A consent order is a form of court order. If you've agreed the asset split, a solicitor drafts a consent order based on that agreement. That is submitted to the court for approval. Once the court has approved the consent order, it is legally enforceable. If you have a consent order that has been through court, you have a court order.

Do you mean consent (financial) order or child contact order?

Threatening not to bring a child back after contact doesn’t have any relation to a financial consent order.

If, on the other hand, it is just about the children, then it isn't a consent order. You would at that point have an informal agreement about residence. You can apply to the court for a Child Arrangements Order, which would formalise that agreement. The court would follow the 'no order' principle, where it will only make an order if it really needs to. Threatening not to return the child may be enough to persuade a Judge that they should make an order, if you have proof of that (e.g. texts). You would ideally need to engage a solicitor (although you can represent yourself) and apply for a CAO. The application for a CAO costs £215, and is done by filling out form C100. More details at:
