How long to wait for court application?

Just wondering if anybody here might know roughly how long it might take from handing in papers to getting a date through?

It's my partner, he's applied for an enforcement order, as we already have child arrangements order. Ex has stopped contact & all communication. No reason given.

Just looking for a rough idea of how long it all might take.

I received a date for court and the actual hearing within a month of filing the application.
Think it depends on how busy your court is and if there were previous proceedings etc :-)

Thank you @FinallyFree123456789 . I was so hoping it would be a bit sooner than that. I'm having a baby in 7 weeks and will feel awful for dsd if we don't get it sorted before then.

6-8 weeks here (if they don’t lose the paperwork). You can ring them and ask if there’s a date rather than waiting for paperwork.

@cheesecakeforbreakfast

You can always call the court and ask them if they have processed it yet.
Mine are fairly helpful with time lines and updating us before paperwork has been sent out

Thanks @FinallyFree123456789. That's really helpful. I'll get him to give them a ring.

Have you forgotten about the “holiday” you were going on next week? You would need to put an “emergency without notice application” in to ensure you can still take the ferry to France for the day.

On a side note I’ve never understood why a holiday or Xmas is seen as an emergency by the courts but a spiteful parent effectively kidnapping your child for months is not.

What do you mean please?

cheesecakeforbreakfast · 25/01/2019 19:51

@Parent999 is that meant for me? Have you confused me with somebody else? I have absolutely no idea what you are talking about sorry.

Sorry I was being discreet (funny?)

Book a day trip to France next Friday and then you’re allowed to submit a without notice emergency application. Impending holidays are time sensitive and will go through quicker. And while you’re there tag on the enforcement.

You really need a barrister to pull this off and it could back fire of course.

I’m just saying that if one parent stops the other parent from seeing their children it’s a normal application 6-8 weeks. But Xmas and holidays can be classed as emergency and (as one solicitor boasted to me) can be in court in under 24 hours.
