yet another maintenance battle

I have had to come here for advice many times.
This is now the 3rd time this year the employer is failing to pay. After every 1 or 2 payments, they miss the next 1 or 2. I believed a DOE whilst he is still employed by same company offered me some sort of guarantee. According to CMS they cannot force the employer to pay and rely on good faith.
We already struggle every month and the maintenance though not alot is more than our food all month. As sons dad left me with a load of his debt ive had to cut everything back dramatically.
I am wondering whether to get the MP involved again but this will be for a 3rd time. It clearly hasnt had any effect and every time I speak to CMS they always side with the employer.
In 3 years of the case it was paid perfect. I didnt have to worry. This year has been nothing but a battle and it gets to me as my son exists and needs to eat, and has now started school so there are always expenses for me to pay out

I wanted to ask for some advice on behalf of my partner as well. I have three step children that are with the same mother. We have them 160nights a year and our child maintenance is 270 a month. Should this cover clothes for the children or are we meant to still go out and buy clothes for the children when they come to stay with us?

Sympathies OP, I have to battle for CM too. Ultimately you'll have no doubt paid CMS to take on your case, if they're not doing their job collecting then you can go down the tribunal route, I did this and won my case (they'd reduced the CM without informing me). I wouldn't be paying his debt though, are they in your name? Maybe speak to CAB about that. Food and essentials have to come before debt. If they are in your name and you have to pay them contact the creditors and ask for a payment plan that you can afford.

The debt was all in my name so legally it is mine.
I need to do something about it as the inconsistency really affects me. I will speak to debtors to see what my options are.

Please don't apologise about asking your question Ashlee03. I'm not sure how that maintenance is calculated. My sons dad doesn't see him by his own choice so primary care is with me. My son should be getting £41 a week but in the grand scheme of things I don't think under 200 a month is very much. He has to be fed, clothed, kept occupied, taken out, childcare, school uniform, trips etc.
Not the best advice, sorry x
