My ex and I separated years ago. At present he sees our 2 DC's 2 nights a week so I receive a payment based on the CMS calendar.

He's had a DC with his fwb and they've given it a go. 1 month into it it's now clear to them all its not going to work. The DM will have the DC 7 nights a week because of age and feeding.

How do things now stand for my DC's and I? I'm not for one minute thinking he should not pay for his newborn but this will, I imagine mean that I get less every month and this will have repercussions for my DC.

How will the CMS calculate this?

They will take it into account and your 2 would receive less by CMS but there's nothing to stop your ex maintaining his current payments to your two if he chose not TO.

I doubt very much he would choose to do so...he's already told them to the penny how much he pays and that's why they do more with me than him, but that's a story for another day!

They will take the new baby into account and drop your CMS accordingly.

It’s a shite system, but I guess it’s the only way to ensure each child gets something at least.

The whole maintenance system needs to be overhauled, it’s broken beyond repair.

I'm afraid I don't know the % they use but if you know his income you can go onto the CMS calculator and put the details in yourself. I agree with the pp that its a terrible system though.

It's 11% less - I've just enquirer as I'm in the same situation. Doesn't matter if child 3 is living with its father or not
