How do i split up with my husband?

Ok so me and my husband have not been getting on well at all for a long time, long story short is that we argue every weekend about stupid little things and just generally dont get on.

We have talked about splitting before but he always talks me round,i get the feeling he doesnt want the hassle more than anything to do with me though,i am sahm to our 5 home schooled kids,he earns a igh-ish amount from work and knows he would probably be worse off if he had to pay maintenance and stuff.

Anyway i have had enough and want to leave.I just dont know how.We have a joint bank account,so i have access to money and stuff but we rent not own our house.

He would not leave.I cant leave because i couldnt get another house to rent as i have no income, although i do have money for the deposit and rent.

I would have to go onto benefits for at least the first few years as my baby is only 4 months old.Does anyone have any experience or advice please?

Have you talked to anyone about how much money you would be able to claim in benefits? It may be your starting point for deciding where to live. If you can claim housing benefits, there are many landlords who will take you in. You need to know how large a house you are entitled to based on how many children you have of each gender. You might like to call Gingerbread, they are excellent at dispensing sound financial advice in my experience.

Then you need to talk to hubby and not be talked out of it. Ideally you will remain in the marital home so the kids don't have to move. If he refuses then you have no option. Would any of the kids stay with him perhaps? Is he likely to withdraw money from your account and deny you access to it or can this be done amicably?

Just a word on the joint account: maybe worth going along to the bank and telling them there is a potential marital dispute and that you want the account put on corresponding "alert"....NatWest do this. Don't know about other banks...

CAB, Womensaid, solicitors - get some advice on how you would go about it. Forewarned is forearmed and all that.

Could you set up your own bank account?
