CSA did a calculation based on my ex living with his new partner and their 1 child together so a percent of money was taken off for the child living with him.

They have now split up and the child is not living with my ex so what happens now? Will my payments go up because they don't take that percent off or do they go down as he will be paying child maintenance to his other ex partner.

It will stay the same, or payments will go down as his ex will also be entitled to a percentage of his wage.

Your payments will definatly not go up.

It will be 20% of his wage and you'll get half each.

So say it was £200.00 per week, £40.00 is payable (20%) and you'll get half of this and she'll be the other half so £20.00 a week each.

If the child isn't his then he won't be paying maintenance for the other child, so it would be 15% of £200.00, so you'd get £30.00 per week in that case.

Thanks for that - very helpful.. I haven't had any money from CSA since last summer and just trying to keep a check on what I am owed. Every time I ring them they say they are doing criminal proceedings but it can take months to sort. Hoping I will get it one day as it has been a pity without it.

It will go down if the other mother claims maintenance through the CSA.

So say he brings in £200 per week.

You would previously have got 15% (one child maintenance) of 85% (as he gets a 15% disregard for having a child living with him) of his wage. So 200/10085/10015=£25.50

If the other mother claims through the CSA they will take 20% of 100% of his wage and you will get 10% each. So 200/100*10=£20

If she doesn't claim though the CSA you will get more as you will receive 15% of 100% of his wage. So 200/100*15=£30

thanks for the helpful break downs.. I think I would have difficulty proving that his other child doesnt live with him anymore so I may have to leave it for now.
