Lost my job - does that affect maintenance paid by NRP?

Yesterday, I was told I was being made redundant. That's one problem in itself but my question is how it may affect maintenance paid by ExP for our DD. The maintenance is paid through REMO as he lives overseas and on 15th August, there is a review of the amount he must pay. My part in that review is to prove my income/outgoings after which they re-calculate what he pays.

I seem to have got it into my head somehow that any calculation will be on joint income and that if one income level drops, the percentage of what he will pay drops. Have I got the wrong end of the stick. Thanks.

p.s. he currently pays £300 per month.

If you have no earnings your child's need of maintenance will increase so your ex may have to pay more if he is deemed to have the ability to do so once his living expenses are deducted from his income. However, the court may base a decision on your potential income.

I don't know about overseas, but CSA base payments on his income, doesn't matter if you are a millionaire or on the dole.

Just to clarify, the CSA normally has no jurisdiction when the non resident parent lives abroad. The parent with the majority of care has to apply for a court order which is then registered and enforced through the Reciprocal Enforcement of Maintenance Orders procedure.

When the courts make an order for child maintenance the starting point is the CSA rate but the judge is directed by the law to also consider the obligations, responsibilities and finances of both parties including incomes for the foreseeable future. See s4 Schedule 1, Children Act 1989.

ItsRaining you can apply to courts for variation order. This however reasses the whole case only if you know ex can pay more and proof in wages then go for it as you need the extra help at this time.

I still have not heard from courts...I had to give up work and ds disabled etc trouble is they need to take it back to courts but when you got a useless gobshite who goes on run from courts because they need a willing df to pay then in my situation I am stuffed! The shite is still on the run!
