They need a tenancy agreement - He doesnt have one he rents from his family. Or his driving licence - Still registered here.

Will they accept his council tax bill, electric bill and P60 as proof???

Not sure what else I can do??

Doesn't sound right to me - my exP lived in a caravan for several months after moving out so definitely didn't have anything like that. And I'm sure that it shouldn't be up to you to get hold of his tenancy agreement.

Are you sure they don't mean they want to see yours, ie to see that you now have the tenancy agreement just in your own name?

I think its odd. I think someone I know (who thinks we are still together) has phoned them. I asked why they need it and apparently they run checks on people to make sure its accurate. He did move out a few years ago and then moved back in so maybe they are checking!

No, they want to see his. They have run a check on his new address and he isnt listed for anything there. He has been living there since January!!

They are checking a lot of people. All I had was the document from mediation giving his new address but they accepted that. Just send a utility or council tax bill and you should be fine.

Brilliant, thanks. I will stop worrying now!

What???? I just rang them.

You don't mention what your relationship with ex is like, can you ask him for it? I'm sure if you can't then just tell them it as bluntly as possible on the phone. You can't magically produce a tenancy agreement which doesn't even belong to you! I overreact as a hobby (it's sort of an accident, but I might as well accept that's what I do!), so I'd want to know an email address which I could appeal to, email them confirming what was said in the phone call, asking them for written confirmation of their totally unreasonable request. They probably won't. And if they do, sod it, take it along to your local MP.

Good luck!

If he's been moving in & out they have to check - can't see a problem with it myself 121 & I have been through a full check where they seemed to want every single document!!!

Go to CAB and get them to call them up on your behalf. When I went there they were happy to chase all the various benefits people to make sure I got some, so I am sure they will advise and help you with this.

mama2moo · 30/05/2012 19:30

My exdp and I are still good friends. He has no tenancy agreement now but has council tax etc in his name at his new place. I will send it off to keep them happy.

I just hope thats enough. The woman was a real bitch on the phone!

I just cancelled our old claim and started a new one as a single person.

Oppsididitagain · 10/06/2012 21:04

They are not permited to ask you to provide a third partys info check there own rules on the tax credits website look under cliaiment compliance

Oppsididitagain · 10/06/2012 21:14

Forgot to add under there OWN rules data protection prohibits them from asking you to provide anything that you have no legal right to obtain this covers anything relating to your ex there confidentially rules also prohibit them from requesting anything that inorder to obtain forces you to disclose you are a claiment they can also not disclose this to anyother party apart from the gov or an employer.
Under there own rules it is the nature of your relationship that matters not where he lives I.e are you still in a serious relationship or are you living togather as tho you are man and wife. People living under the same roof but not as a couple can and should claim as a single person
they can ask for ... Bills bank statements tenancy or anything solely in your name but they cannot ask you to provide anything allong those lines if they are just in the name of a none claiment.
These are there OWN rules we are expected to follow them that means so do they this is the law go check it out yourself
