Ex- is spending £13,000 per month & the CSA have assessed him at £200 per month maintenance

I desperately need some help. My abusive ex- is a Company Director and 18 months ago was paying £2,500 rent, £900 HP on a car and £1500 maintenance. It all stopped overnight in April last year with no warning. My daughter and I had to move out of our home, the car was re-possessed- no way I could afford those on a part time salary and have to scrimp and scrape since then. I contacted the CSA for their help (he had been maximum assessed in 2009 but I had no need to use them as he was paying a lot of money on an 'amicable' basis) and for 2 months he paid £1200, then he appealed and they assessed him at £120 per month maintenance based on his salary alone. I appealed and in Nov 10 they assessed him at £500 per month but based on information I knew wasn't up to date. The CSA referred the matter to a Tribunal which took 12 months. The Tribunal assessed him at £200 per month last week when it is undisputed he is spending in excess of £150k per year. To top it all off they have deemed he has been overpaying me for the last 12 months and he has to give me £10 per month for the next year whilst he is spending £13,000 per month... I have been advised it will take me 12 months to appeal and I won't be able to keep the food on the table. Does anyone have any advice/ a similar experience? I've written to my MP and I'm waiting... is it just me or do the numbers not look right?!

SaraSidle have you been through something similar? Did you appeal? If there's lots of us can we add some weight to looking at the legislation?
If he didn't have any money I wouldn't mind but it's her that's suffering. I can't afford to do anything with her and he won't tell me where he takes her for activities that he has booked because she's not allowed to do anything with me that he's paid for.
I've contacted solicitors and they it's CSA law and they don't have the knowledge. I've found the odd company but it's £150 per hour. That's going to take a long time to save up for even the first session!

It would be worth making contact with your MP but if it has been a tribunal it maybe difficult to overturn. How do you know about his expenses, what was stated in the tribunal? Does he work now on a PAYE basis?
Were you married, if so are their martial assets?

Do you know of NASCA?

i agree with Smum99 definately contact your MP ( i did) my case was different but i got results via the MP because CSA alone are useless make sure you gather as much evidence as you can

Is it based on his income or via departures. I asked for it to be done on departures and suddenly maintenance went up.

This is when they look at the NRP lifestyle rather than declared income.

Thank you all so much. Written to my MP and I will also be writing to the head of the CSA.
I had access to his personal bank statements through a separate court Schedule 1 action but surprise, surprise by the time he'd provided financial disclosure (2 and half years after it had been requested) he wasn't maximum assessed so there was nothing the court could do. It's clear what he's spending but the Tribunal looked at his salary of £10k and £120k of equity in a business property (he gets £75k per annum in terms of rent from the business, £75k per annum Directors loan and has spent ~£250k over the years by extending the mortgage on the business premises that he personally owns). There was a representative from the CSA there who said that the rental had to be included as income and the Judge seems to have ignored that....
The Tribunal ignored lifestyle inconsistent and said it wasn't valid....
