interview under caution help!!

please help

i have recieved a letter asking me to go to an interview under caution, i am on income support, i have 3 children an i'm in an on/off relationship with my youngests father he does come round to visit and on occasions has stayed over.

My main worry is that although we don't live together he has used my address as somewhere for some of his mail to go to due to the fact he has no fixed aboad and is always staying somewhere different.

I am very worried about this interview as i feel if they just wantde to clear things up with me they would of done this through a home visit, can anyone offer me any advice please?

I would take someone with you.

There interest is whether he contributes financially or not. Why would you agree to him using your address if he does not live there/financially contribute?

If he is claiming benefits and using your address then it's all very suspicious to them.

he works but can't afford to rent his own property as he only recieves a low income and most of that goes on the csa he has to pay for his other children

Don't know who to take?

Have you got any friends or family, just someone who will help you remember stuff/give you confidence.

If he ever buys groceries etc that counts as contributing financially btw.

It's a tough one as it comes down to your word against theres.

If you were in their shoes would you believe someone who claimed that a man with whom you have a child stays over, uses your address as his own doesn't contribute financially Confused

i know what you mean lookin at my situation it doesn't look good!!

I am thinking that this would be there eveidence to say he lives with me and i don't know how i can prove he doesn't even though there are very few letters that come to mine

All you can do is admit that you are a soft touch and because you want your youngest to see him you let him use your address and sometimes stay over.

I am really worried about this situation as you hear so many storys of people even young moms that have recieved prison sentences for fraud.

I know i haven't commited fraud but think that proving this to them is going to be very difficult!!

I think your right i will have to say that i was very nieve and didn't feel it would be a problem as i thought it would just be until he had somewhere more permanent to stay as its the truth

I would try and clarify the dates and write down when the relationship was on and when it was off.

Have you asked him to take your address off his mail?

I think you need to be clear that he doesn't contribute financially to the household either by buying groceries or anything like that.

Can you go to see the Citizens Advice Bureau or a law centre for some legal advice?

If your on income support ensure you have a legal representative. It's a sad but true fact that policing is measured on results, therefore the police will not be interested in what's is fair, right or (in my sad experiance) infact true. If they tell you, you won't need any legal representation, don't listen, they don't have your best interests in mind, they have their own interests of being seen to catch criminals.

I simply can't stress this enough get legal advice and they'll go with you, it doesn't mean you have anything to hide, you've done nothing wrong. Your simply getting an expert to help explain to the police who simply want to impress their superiors at how many 'bad people' they can catch, that you are not one of these people.

Does he have an address elsewhere of any kind? Can he provide proof that he has substantially lived elsewhere? This is important because if he lives elsewhere he can't live with you as well.

If not then it's going to be difficult for you to show that you aren't living together, but remember they have to make their case not the other way around.

I would take professional advice as soon as you can. You can do so before the IUC if you wish. If you're on IS you may be entitled to free representation. At the very least take someone with you - a friend or a relative, for moral support.

Remember they look at a range of issues and not just one to decide if you are living together. The presence of someone under your roof is not conclusive although it will be suggestive. For your benefits to be affected you should be living together as if you were husband and wife or civil partners, so they will look at finances, they will look at how you appear in public, they will look at who cares for the children, and so on. Think of all the things that suggest that you lead separate lives and make a list so you son't forget to mention them.

I am thinking of going to my local cab on monday for some advice been reading alot of similar storie and to be honest now i'm worrying even more about the whole thing!!

He doesn't have a constant address at the moment is staying with his aunt...he hasn't moved in with me as we wanted to make sure we could make it work first my older 2 have been through even trauma already and we was only last week thinkin of living together and applying for wtc and ctc but feel we shouldn't now as it may make us look guilty.

we have no joint bank accounts and he doesn't give me any money i look after myself and my 3 children.

Oh sorry I thought it was with the police, i'd still seek legal advice on it tho, and have the same healthy there out to stitch me up so they can be seen to be efficant at their job.

Yeah defo going to the cab on monday got the letter this morning and my interview is on thursday so not alot of time really!!

do you have the same kinda thing happening to you aswell?
