Major concern about Rented house in Brussels

Hello, this is regarding our 2bhk Flat in krainnem where we were going to shift on 1st September. We have signed rent agreement to move in this house and it is on 3rd floor.
yesterday we happened to be in that area and we just visited our apartment from outside and we noticed bizarre situation and now we are really concerned if we should move in that house. We noticed that 2beams of one of the bedrooms is fallen down on road from 3rd floor .we fail to understand it is newly renovated house and we are going to be first tenant. How is it possible to fall down?? It is indeed raising question of quality of construction and we are scared to move in with our daughter. Please tell us what should we do...we are already going to take pictures and write mail to Broker who is dealing with that property.

This is very difficult situation for us..we dont know what to do and we also noticed sepage of water on rooftop near windows..
please advise what it best option at this moment.

You have signed the agreement and if you do not wish to move there, you will have to hand over 6 months rent - 3 months penalty and 3 months due to no notice.

I do not know what 2beams are but if it is something on the inventory as not being broken, the landlord must fix it. Sometimes things go wrong in renovations. We moved to a renovated house, some of the bricks in the cave fell off the ceiling, no big deal, landlord came and fixed.

If you haven't had the inspection, point the defects out at inspection and insist they are fixed.

You should really be dealing with the landlord and not estate agent, unless the landlord is absent and agent is their rep.

beams are window seal of the window.it is used to fill gap of window frame and wall.In this house they have used big blocks of stones.
when I signed the contract everything was okay but yesterday I saw it.

This broker is rep of landlord.
I think I have valid points to have my concerns. I understand I have signed contract but any contrcat can not force sombody to abide by when I see such threat to life.
anyways I ahve written my concern to broker and I will wait for his reponse.

I would like to move there as it seemed nice house and we already bought furnitures for this house.my only concern is that i will not move untill these things are fixed.

Sorry but you are indeed obliged to pay now and if you don't it will inevitably end up in court with you losing. Yes you are bound by law.

Just talk to the landlord and get it fixed.

Where have you posted the photos?

ARe you on any of the belgain expats pages on FB? You might be able to get advice there.

As a belgian resident, I do understand your concerns about construction.

You need to get hold of the LANDLORD not the estate agent really. The landlord may not even be aware. It's not going to affect the interior of the apartment, it's a risk for anyone walking past.

I would also consider informing Kraainem "urbanisme" department, as the danger is to passer bys. Pass on to them the urgency of the fact any more falls like that could result in a serious injury or worse.

I still think you might have problems getting out of this contract.

Do you know if the apartment got new windows because that's going to be the most likely cause of the lintel falling down, in which case the landlord would need to call back the glaziers to fix it?

Checking the building on google maps, the lintel has come down on the right of the window and above too. Looking at the condition of the 2 lintels on the ground, they've been pulled down, not fallen down, as they are not smashed up, so it's likely the landlord is quite aware and in your position, I'd be asking the landlord directly. You could also go and ask the shop below who might have the same landlord if they know anything about why the lintels are on the ground and how long they've been there.

Lintels shouldn't come out when new windows go in. They are part of the structure of a building and are needed to hold it up.

and I only want to move in when all these things are done porperly.
what do you think I have right to wait for one more month???
I have to move on 1st but if this is not fixed I can wait untill it is fixed.

You can move in when you want but if you've signed the contract for 1st September, you need to pay from 1st September. It's no good speculating, you need to contact Kraainem commune for advice and the landlord.

ps a lintel can be structural but can also be ornamental and have no effect on the structure of a building which is why I advised to contact Kraainem planning department as they could take a look and advise.

and also I tried hard to get him on phone yetserday and he himself was not aware of this situation that it is down.I asked him to see pictures and then he might have seen..i have no idea what he is upto.
