car accident claim

a bloke drove into the back of me and is now saying that I rolled back into him (or rather his solicitors are) he admitted liability at the scene. I cant actually remember where the accident happened, he says it was on a hill but i think he is just saying this so he can claim I rolled back.

what will happen if his side refuse to admit liability? my solicitors say my insurance company will pay but do they have to?

Your insurers have to pay for the damage to your car providing you have comprehensive cover. Whether or not they pay for the damage to his car is for your insurers to decide. If they can't agree with him or his insurers it may go to court, in which case you will be called as a witness. The fact that you can't remember where the accident happened won't help, I'm afraid.

However, as far as you are concerned the issue of blame will only affect your no claims bonus. If the other driver is to blame you should be able to keep your current no claims bonus.

However, there are no circumstances under which you will end up paying for the damage to his car. That will be paid by your insurers. That is the whole purpose of forcing everyone to be insured.

thanks for your replies! We also had a hire car when ours was being repaired, will they pay for that too? we had a letter from a administrators a few months ago saying the bill hadn't been paid and the hire car comapny had gone bust, the admninistrators were collecting the outstanding debt.

That depends on the terms of your insurance. Some policies provide you with a car while yours is being fixed, some don't. It should tell you in your policy document.

I'd refer the administrators to your Insurers for starters. What if the hire car co had been paid, but shoddy financial practices meant that the money is not showing as being paid.

It's in your insurance company's best interest to fight the other side and not settle on a knock for knock, so just go back to your insurance company and tell them absolutely that they are trying it on,and that you stand by your statement, and that the guy admitted liability at the scene.

Stand firm, they are just trying to pull a fast one, usually whoever runs into the back of another driver is to blame. Let the insurance company deal with it.

Even if you did roll back it is still his fault, as I understood it, the fault is always with the car behind. Why was he that close that you could roll into him?

No, the fault is not always with the car behind. If the other car is stationary and you roll into it, it is your fault.
