DP bought a car in January. Very long story, but the upshot is that there was an overwhelming smell of diesel. His mechanic found a pool in the back well. Took it back to where he bought it from, and they cleaned it, but couldn't get rid of smell, which by this point was causing an eye infection. His GP says it's diesel poisoning. Asked for refund, and they refused. As bought on credit card, went through s 75 procedure, and has been refused as 'no corroborating evidence.'

Now is with the Financial Ombudsman, but isn't it enough that DP has been examined by his GP and his constant eye infection is caused by diesel poisoning, and an independent person found a pool of diesel in the car?

I think if DP gets an independent report (private consultation, I'm afraid) from an opthalmologist this will considerably strengthen his case. I think this is whats meant by the 'corroberating evidence'. I think a car which is stinking of diesel and makes someone ill is 'not fit for purpose'. It would come under the 'sale of goods act' so trading standards may get involved if you had proof injury had been caused and health had been put at risk.
