returning items without the receipt

I bought dd a cardigan last week and when I washed it at the weekend it shrunk.

I washed it at 40 degrees like it said on the label and when I took it out of the machine it had shrunk.

Obviously I want to take it back to the shop but having searched everywhere I can't find the receipt,ggrrr.

Where do I stand legally in this situation?

I'm willing to take a replacement but I'm worried if I do and it also shrinks I'll be left out of pocket.

Can anyone advise?

You don't have to have a receipt legally but it is easier for the shop to wriggle its way out of its liability if you don't. They can claim that you didn't buy the cardigan from them, in which case you will need to be able to prove that you did. You could use a credit card slip, credit card statement or similar. In this situation the shop could, of course, argue that you bought something else which cost the same as the cardigan.

I don't have the credit card slip as it was bought in M&S and the credit card slip is part of the receipt.

I also bought it along with another item so although it's on my credit card statement it will say m&s £x amount but that was for two items.

It is obviously an M&S item as it has their label in it they can't deny that I'm just not sure if they will replace it or not.

As it is M&S it is unlikely you will have a problem. Their policy on returns is very customer friendly. Their website says, "If items are returned with an expired receipt or parcel summary document or without any receipt, we will offer you a credit receipt or exchange to the value of the last known selling price."

It is a washable cardigan and you cannot wash it.

Without the receipt you are not entitled to a refund of your money. Though the shop may chose to do so.

You should be offered a credit note though or the ability to exchange it for another item.

M&S are very good, they will give you a credit note, I am sure.

e credit card receipt is fine as it states where you purchased and when. They can the look up that amount on computer and it will show the item you bought.

However, some shops will only refund the current selling price and will only offer a credit note because it's not being returned "as new" nor is it "faulty" as such- although you could argue that if it is shrunken then it's not fit for purpose.

Its unlikely that you bought an M&AS cardi anywhere else other than M&S? They usually very good with returns so just bring it back. (Only problem arises when said item now at sale price)

I had to take a pair of shoes back last week after 6 days as they had fallen apart. I didn't have the receipt, as I thought once I'd put them on my daughters feet and she'd worn them I wouldn't need it.

It was Next, and they were fine about it and let me exchange them for another pair or anything else in the shop. Couldn't give me a refund as I didn't have the receipt, but were happy to exchange, no questions asked.

I was happy as it meant my daughter didn't have broken shoes anymore!!

It's not at sale price I only bought it a week past Friday.

I'm so annoyed that it shrunk,it was such a nice cardigan and really suited dd.

Like I said in the first post I'm happy to take a replacement of the same cardigan but I'm worried that it will also shrink and then they might not let me have a credit note next time iyswim.
I'm also happy to take a credit note but dd really liked this cardigan so would like a replacement if possible.

I'm also extremely annoyed with myself for losing the receipt, I have every other receipt from that day as we did a big clothes shop and have managed to hold onto all the receipts except this one.

I would take it in, it is M and S, they don't like to upset customers and will either replace it or give you a credit note I would assume. They are likely to give you a reciept for the new one that you take off them if they give it to you so if you have the same problem again it shouldn't be too much of a problem iyswim.

(incidentally it was def a 40 wash? only my beloved dh attached the washing machine directly to the hot water pipe..... lots of things shrunk until I asked him he had done this as the water was quite warm and the rinse wash always came out steaming....)

BigBadMummy - I repeat, there is no legal requirement to produce a receipt. However, if the shop argues that you didn't buy the goods from them you will need some way of proving that you did.

Yes I definitely washed it at 40 along with other dark clothes that I always wash at 40 and I have never ever had anything shrink before.

I checked the label too, before washing, just incase there was some special label instruction and there wasn't and it is the same label as the school pinafore and school trousers and my work trousers have, all bought from M&S.

Ok, thanks for all your advice I'm off to Markies now to see what they say.

Good Luck Linnet - I thought it highly unlikely that it wasn't a 40 wash - just my daft dh that made me shrink stuff........dipstick!

I am sure you will find it resolved quite quickly, sometimes they like to know these things as they can go back to the manufacturer and let them know too.

You just need proof of purchase. So even if you don't have your card receipt you can get a mini statement printed off by the bank for a debit card or an online credit card statement assuming you don't want to wait for the paper bill to arrive.

Go back and ask for either a refund or exchange.

You didn't realise that there product was faulty so you didn't keep the receit.

If you have paid for the item by credit card then you will or should have a credit card return on the money side.

I used to test clothes for babies that M&S did with my dd1 nearly 18 years ago - they ask for the item to be worn 6 times and washed 6 times so that they can test how the washing will effect the item, along with how easy r not it is to get on baby and off.

Hi, I took it back explained what happened and how I didn't have a receipt and the lady gave me cash out of the till for it, they didn't have one in stock.
