Can anyone tell mehat happens if when distributing someones estate - all but one of the beneficieries agree that items in the deceaseds home should be sold and proceeds go to charity. The reamining beneficiery wants it all sold and take the cash. Can the executors override?

What did the deceased say about what they wanted to happen to his/her effects?

One solution might be to put everything on Ebay or a local auction house and then split the proceeds equally between beneficiaries (or as per the proportions in the instructons of the deceased) so the the beneficiaries can each decide to give away or keep the money away themselves.

Remember, if anyone donates money to a charity they can reclaim tax income tax relief at their marginal rate. Better still, give the tax releif to the charity which makes the giving tax efficient.

The executors cannot override the will. If someone is a beneficiary they are entitled to their share. If items in the home need to be split between the beneficiaries to comply with the terms of the will then that is what must happen. The fact that some beneficiaries want to give their share to charity is up to them. They cannot force the remaining beneficiary to do the same.
