Can I make a family member Legal Guardian?

I am considering working away from home for a while. If I go, my mother will look after my dd.

I have a question though.

Can I make my mum legal guardian while I am away?

How would I go about that?

Has anyone done anything similar?

It would be an issue of whether your mum needs parental responsibility for dd. Having this would allow her take make all the major decisions, for example in relation to schooling and medical treatment. She can obtain parental responsibility by getting a residence order. There is a government website www.hmcourts-service.gov.uk/ which gives info. You can delegate your parental responsibility, but to be on the safe side, it might be worth putting something formal in place. I've heard of schools, nurseries etc. refusing to deal with anyone who doesn't have parental responsiblity for the child. One thing to consider is whether dd's father has parental responsibility. If so, would he agree to your mum having it too?

He has been out of the picture since she was 4mo but he does have pr. Not sure if he would "allow" my mum to have pr aswell. He is generally an awkward pita (and other nice words )

I reckon I'll have to see my solictor to be sure.

Your Mum doesn't need PR. You can delegate responsibility.

i am legal guardian to my friends children. it was drawn up via a solicitor. i also am executor of her estate should she die. the dad is not allowed access but i believe still has pr.

i have a document,but not sure of the legalities of it!

A court may appoint a guardian if the child has no parent with parental responsibility or
a residence order has been made in favour of a parent who has died while the order was in force.
