Had an accident and MOT has run out. - update!

DH and I decided not to claim for the costs of our car damage yesterday because we had no MOT. But we've been told it's going to cost between £1200 and £1500 and we have plenty of things we'd rather spend it on.

So what are the likely risks of claiming under the circumstances?

  1. They refuse to pay up.
  2. The only pay part of it.
  3. They refuse to reinsure us and it will be impossible to get insured elsewhere?

Was quite chuffed when the mechanic told me that in all his years of rallying he'd never manage to break a steering rack . He also reckoned the other car must have been going way too fast to have done that much damage (which I thought at the time)

Advice please. Pretty please.

It is against the law not to have a MOT.

Orm - just to empathise with you! DP had a minor bump last year (his fault), and rather than go through insurance he told other driver he'd pay to get her bumper fixed. She decided to go through insurance (or had to go through insurance- not sure which!) and ended up claiming for medical expenses. DP was sure that the bump wasn't serious enough to cause her any damage and told his insurance Co this. Insurance co. didn't question her claim at all and just paid up. At time I was concerned that we'd been "treated like mugs", but our premiums haven't gone up, we've kept our no claims etc and insurance co just said that it was a very minor claim to them (though would have been a lot of money to us).

My advice - leave it all to the insurance cos to sort out - that's why we pay them!

After reading this thread and panicing that i wouldnt be insured i thought id reassure people that its total rubbish you ARE insured. My MOT was only 3 days out but in a way thats also irrelevant. The important part is that your car was roadworthy at the time of crash. My car is damanged to the tune of 24k and the insurance company is paying the lot. SO those doom mungers amoungst you back in your box!
