What is the legal position if BT slap a pole down by your garden wall and hit the wall foundations?

Hi there, BT have turned up today, drilled right down into the pavement about 3mm from our 6 ft garden brick wall and stuck a telegraph pole in.

They have hit the foundation of our wall.
What is the legal position?

I notice in other streets the poles are placed at the edge of the pavements away from fences and walls, so why have they bloody well drilled into our wall foundation?

Our wall foundation is 1 ft underground and the concrete footers extend out 1 foot either side of the wall, this is how I know they must have hit the foundation.

i don't know, contact them and talk to someone first i guess would be a good idea

It sounds like the foundations of your wall extend beyond the boundary of your property. BT has a statutory right to erect poles in the highway. Since you say "I know they must have hit the foundation", it doesn't sound like they've damaged the wall. Unless you can show that they were negligent and that they have weakened the wall requiring you to undertake remedial work, I don't think you've got a case. Even then, I'm not sure you would have a case - there isn't enough information here. You need to consult a solicitor if you want to know for sure - many operate a scheme that gives you an initial half hour consultation free of charge.
