We split a year ago but XP still hasn't taken all his belongings. Do they become 'mine' after a certain amount of time?

XP moved out a year ago and left a mountain bike, DVD player, tv, printer and a few other small items. Last Spring he said at I could keep it all, which I have record of on an e-mail.

However we had a failed mediation session in the Autumn and he said he wanted it all back. He asked me to take it to his house which I wasn't prepared to do as it would involve taking the dc's or arranging babysitting for me to go out, he has been abusive in the past so I would rather avoid him. I have asked him a couple of times to arrange for it to be collected by his brother or a friend, even offering to drop it off at his friends house who lives near me, but XP hasn't got back to me or arranged anything.

I'm fed up with it TBH, anyone know if he doesn't really have a leg to stand on and I can just keep the bits that I need and clear out the other stuff without worrying about any potential legal problems?

You can't just assume ownership and dispose of it unfortunately. If you threw it out or destroyed it technically he could report you for theft/criminal damage.
You should write to him (recorded delivery) so he can't claim he didn't get the letter and give him a set time to collect his items or arrange for someone else to collect them or accept delivery of them.

I know its a real pain to have to do that but you have to cover yourself in case he gets nasty if you get rid of it. In the letter set out a timescale for them to be collected/delivered. If he doesn't collect or arrange something have you a shed or garage you could leave the stuff you don't want in?
