What a lovely thing to come home from your holiday to! [hmm]

Came home to find, on the doormat, what appears to be a summons for my DH. That's what I think it is anyway. It says Interim charging order at the top and is from a County Court.

It's about a very large amount of money he apparently owes to some un-specified company and the letter came via our mortgage provider. It looks like the Courts have tried to find DH via them.

Anyway, it's nothing to do with him, and I can only guess that they're looking for someone else with the same name as him.

He's never lived at the address that is mentioned in the letter, nor even the town! I'm assuming the money is about that address but I can't understand the legalese at all .

The hearing is due to be heard on 8 September so we need to sort it by then, but I haven't a clue where to start! Should I contact the court? Or find a number for the solicitors that are mentioned (there is no number for them on the letter)? Or what? How do we prove DH isn't the debtor?

I've heard that debt collectors sometimes take 'pot luck' when chasing up money and just pick someone with the right name / age / town. My gran was chased for money after she died, despite it clearly having nothing to do with her. It all got sorted out in the end. My dad had to keep telling the company my late gran wasn't the person they were looking for, he was a bit gutted it never went to court as he said it would have made the debt collectors look like idiots if it had.

You must call them on monday and maybe get to CAB for more help.

Ask for a copy of the signed loan agreement. Is there a DOB on the form?

No, no other identifying information at all. Just his title, initial and surname, and this random address.

Asking for a copy of the loan agreement sounds good. Who do I ask though? The solicitors or the court?

There is no company name on the letter suggesting which debt collection agency is doing the work.
