Do I need to mention an accidental council noise complaint on TA6?

Do I need to declare this on the TA6 form?
Really ridiculous and I don’t want to ask the solicitor! My husband has no idea and he will be so mad.
Last year when having friends round for drinks in the garden, a few houses down had someone playing the recorder (I think) for an hour or two. We found it funny at first because we have all been there, but after a while it was starting to get really annoying and showed no sign of stopping.
A few wines in and my friend says you can report things like that on the council website. We have a look and go through the form. At the end I click cancel and closed the page. I obviously had no intention of making the complaint. A few minutes later I get an email confirmation for my submission.
I log onto the council website and there it is. I click on it and it gives me the option to close it so i do.
but I don’t want it on my records so I email them immediately and explain it was submitted by mistake and can they remove it. They have marked it as submitted in error but it’s still there.
Do I have to declare this now we are selling?
There never was any dispute.

and if we put no and for some reason it comes back on us, if the original email of me explaining it was submitted in error enough to cover us?
it’s so ridiculous and I hadn’t thought about it until we have decided to put our house on the market this year

I wouldn't. It takes two to make a dispute and your neighbour was never involved.

You made one complaint about someone playing recorder.??
Do you think as a buyer you need to know that sue in number six once playedthe recorder for two hours?
Does sue still annoy with recorder playing?

I guess it just threw me that everything online seems to say you should declare it if it got raised with the council and therefore became an official complaint

Although it never got raised with the neighbour and is marked as withdrawn on the council record, I just wanted some reassurance that I’m not in the wrong not declaring it on the form

if it ever came up I could obviously explain and show the email I sent two minutes later withdrawing and saying it was submitted by mistake

But if ‘Sue’ ever did take up the recorder again and the new owner complained, would there be a log saying there was a previous complaint?

Ask your solicitor.
This won't be an issue but honesty is usually advised.

I am not a conveyancing solicitor but would suspect you would be ok not to include - it was in error, council records will show that and the neighbour was never contacted. The risk arises if you don’t disclose something that turns out to be an issue for the buyer, so unless there is in fact regular recorder playing at unsociable hours that might reasonably bother someone, it is hard to see how this could be something that could lead to that sort of an issue.

HOWEVER, please do ask your solicitor, for a number of reasons. First, what is and isn’t going to be something to include is nuanced and they are paid to advise on and are experienced in just these things. Secondly, by asking them and getting an answer, you are covering yourself. If you don’t disclose because you decided you didn’t need to or a random on MN told you, that’s on you if it were to turn into something. However, if you don’t disclose because your lawyer told you that you didn’t need to then you have recourse to them and their insurance if necessary. This is what you are paying them for.

Love the fact you and friends were in the garden, drinking, having fun and (probably) making a noise - and you choose to make a noise complaint!! Maybe the recorder was attempting to mask your noise!!
