Parking fine help needed

I drove to home bargains and found it not open. There were a few other cars parked outside and another car drove into the car park after me, so I waited in case it was about to open. Then checked the times on my phone and left. I’ve received a parking charge for using the car park for 7 minutes. I did appeal. I was honest and explained what happened, this was rejected. Apparently I can appeal once more through a different channel but will have to pay the full £100 if they don’t agree. Is there anything I can say to help my case? I didn’t notice the sign facing out onto the street, no exactly easy to see and read before you go in. The terms and conditions are on the signs inside the car park but the one facing the street does say not to use when the shop isn’t open but the store open hours are inside the car park so you have to go in to see them. Do they have to allow a certain amount of time to read the signs? I was there 7 minutes.

Are you under the impression small claim / MCOL cases are reported in case journals?

So despite admitting that you are not a legal expert, you want to continue displaying your lack of knowledge and understanding of the law, and arguing with people who actually know the law.

Let me be clear. Beavis vs ParkingEye was heard by the Supreme Court. They did not make any findings on the facts of the case. That was dealt with by the lower courts. The Supreme Court was concerned with interpreting the law. They decided:

  • A car park operator has a legitimate aim in charging people for breaking the terms by overstaying and that, provided it is not unreasonable, it is legally enforceable
  • A car park operator can enforce the charge for overstaying even if it has not suffered a loss

These findings of law are binding on the lower courts. In any situation where a car park operator is attempting to enforce a charge for overstaying, the lower courts must follow the Supreme Court precedent. No ifs or buts. That is why the only way a driver will win in court is if they can show that the signage was inadequate, the payment machines were faulty or there were mitigating circumstances.

As @AgentLisbon says, small claims such as these are not reported in the press or in case journals. Even if they were, given that the consideration period is at least 5 minutes and the grace period is 10 minutes, the only cases where you will find people successfully sued for a 5 minute overstay will involve airport drop off parking or similar. Despite your scepticism, the courts have upheld fines for 5-minute overstays in such parking areas.

I would again remind you that your first post on this thread stated that you were not offering sound legal advice. Why are you so determined to contradict those of us who are providing sound legal advice? Perhaps it would be better if you listened and learned.

@prh47bridge So the attached is what we believed to be the case. Pay and display. We paid the amount for 1 hour so cannot see how we are accused of getting it wrong. We didn’t see pay on exit when we were there! However Portishead is not seeing us again.

Is it possible that you parked in either Tower Car Park or East Quays car park?

The boat people state that they are pay on exit.
