Fired without notice - I have terminal cancer - what to do?

Sorry this is going to be a long post I will try to explain as best as I can but I need some advice please.
I have terminal S4 cancer but I'm managing fairly well and until December I was working my usual job with some adjustments and I'd had no complaints about my work etc.
I was first diagnosed in 2022, had surgery & chemo etc and was off sick for 6 months. I returned to normal duties after a phased return and was given the all clear in early 2023. All was fine until early 2024 when I was diagnosed with the exact same cancer, in the exact same place but more advanced than before. I will add that I received awful treatment in 2022/23 from oncology and was left with CPTSD/depression etc and it was obvious that nothing's different this time (both hospitals involved are awful, very dismissive and rude) which led me to deciding not to have any treatment this time and let nature take it's course. Two years down the line I am gradually getting towards the end but I'm still living normally with medication/pain relief/support etc.

I work 14 hours per week (NMW rate) for a very large medical type charity in their retail arm since late 2021 - so I'm a retail assistant in a shop which is a popular busy one. The adjustments that I have had (since about late 2024) are things like no consecutive shift days, extra breaks (rarely needed), no lifting of heavy donations/items, no operation of equipment like vacuums or steamers etc so not much really compared to the rest of my duties. I will also say now that I am diagnosed with ADHD and autism which I declared to my employer from the beginning and it's never been an issue. Neither has there ever been any issues with my work raised and any small issues have been sorted between myself and my manager. I've always enjoyed my job.

I was signed off sick in December 2025 because I tired, felt ill and my manager had been treating me differently and poorly so I was excessively stressed/depressed. I had an occupational health assessment last month which said I was fully capable to return to duties with the addition of no lone working, set work days and to follow the same adjustments as before but mentioned tiredness/exhaustion/tumour pain.
I had an interview last Thursday with my area manager (my manager's boss) and he went through the OH report, asked if I'd consider redeployment/WFH transferring to other duties/job (yes I would), discussed my physical health and medication (low dose slow release morphine). He gave the impression that it was doable and we had a refreshment break. When he returned to the meeting he said that he was terminating my employment immediately from that minute. He said HR will email the decision later that day and that I could appeal. That was it.

I am still waiting for this documentation to come through from HR and I've been told to wait for how ever long it takes. The company's own sickness guidance states that you must appeal within 7 days of being told of the dismissal.
I have put in a SAR to the companies data officer today because I have a very bad feeling over the whole thing - not only have I lost my income/job but I've lost my death in service insurance.

So what can I do? What are my options now seeing as my employer is already being obstructive?

I know that I have a Protected Characteristic under disability law. I have already suffered discrimination from my employer because they have refused to carry over my unused holiday entitlement in 2024 & 2025 and I had to lodge a complaint at the end of last year and in February they agreed to 'award' me my correct entitlement but I had to fight for it. My store manager is very poor and has a history (which is ongoing) of denying staff their correct breaks, being difficult when wanting holiday, restricting access to our own work records online etc. It was a disagreement over my holiday entitlement, plus she told me some outrageous lies, that caused me to go off sick in December.

Sorry this so long but I'm hoping that someone can give advice as to how to proceed.

Sorry all this has happened to you, what reason did he give for dismissing you. Has anyone ever suggested ill health dismissal with you, acas might be able to give you advice. It sounds a horrible place to work, ideally what would you like to do?

I’m so sorry you are in such a difficult situation OP. I don’t have any experience in this area to advise but you could contact your local Citizens Advice Bureau.

Fucking hell the optics of this are stunning. I’m so sorry you’re being treated this way. But I’ll bet there are the usual big law firms who would be more than ready to take this on and at the very least, get you a giant agreement.

This is the sort of thing that will make the PR department keel over.

You need a solicitor and or legal advice. I’m sorry this has happened to you.
In the meantime tell them you intend to appeal in writing immediately. Cancer is a disability. As is autism and ADHD.
A holding email if you will to HR and Area Manager saying
I am writing to formally appeal the verbal decision given to me by Mr X today on Monday 13 th April 2026. As I have not yet received the formal written notification or reasons for this decision I am submitting this appeal now to comply with the company policy that appeal must be within 7 days. I will provide full grounds for my appeal once the documentation is received.

you have a strong case to identify several areas for considerable in your appeal. Cancer is a protected characteristic. So this is well be unfair dismissal, failure to provide reasonable adjustments, discrimination, if your illness is terminal tribunals do not look favourable on companies trying to save on ‘death in service benefits plus of course the problems with holiday pay.

Get your written appeal done as above and remember normally you have to state you are going to a tribunal within 3 months (normally the time frame is shorter than this like it is 2 months and 29 days or something).

You have nothing to lose by appealing as OH said you were fit to return to work. On what basis are they terminating?

They deserve to be put on blast and for the public to know how they are treating you.

@Mothrasstillmoshing Hi OP. I am so sorry to hear that your employer has behaved like this. As others have said, you do need to take legal advice to understand your rights in this situation. It is important that you are advised by someone sensible and efficient as the last thing you need is additional stress.
Speaking to ACAS, your local CAB and MacMillan would be a good start, as others have said. You may find that an employment lawyer would be happy to advise on a pro bono basis in the circumstances.

Are you a member of a union. If you are get un touch immediately. If not give to CAB or Acas. I can't help further than that but these places should know more and can help you.

Your cancer: is it terminal? How do you want to spend the time you have left? Do you need the job? Do you care?

Cancer is automatically a disability under the Equality Act (2010). This sounds like unlawful discrimination as well as potentially unfair dismissal. Call EASS:

I'm very sorry this is all happening to you OP - not just the work situation, but also your cancer diagnosis and general health situation.

Just a general observation, as you seem very worried by the loss of your income, but as someone with terminal cancer you may well be entitled to PIP, UC and AA. If you are only working PT on NMW you may well find that you are better off on benefits than on the wage you've been earning in your job.

Get benefits if you're nearing the end of life

I would put in writing to them that you wish to appeal the dismissal but do not currently have the supporting documents you require from them in writing to enable you to do so. And then contact your MP and probably get some legal advice (union/my home insurance covers legal disputes with work).

Have I understood it correctly, you were in the middle of a meeting about reasonable adjustments and then you were told you were being let go after a break in that meeting?

and you weren't given a reason for the decision?

how much pay in lieu of notice are they giving?

I am so sorry @Mothrasstillmoshing , for your health, the terrible treatment you have had in the past which has led to your decision to let nature take it's course, and your horrible work situation. I have no advice, just sympathy, but others have made good suggestions.
One thing I would say: depending on how it goes with your employer: please name and shame them if they don't respond well to your shocking dismissal.
Even take it to the papers. If they are a charity, I want to make sure I never donate to someone who can treat you so shabbily.

I’m so sorry you are going through this. There is so much wrong with the meeting process that my mouth hung open in shock. You are doing all the right things. Hopefully you will be able to get a solicitor to negotiate a huge settlement for you - I would say hang on for tribunal but claims are currently taking years to reach court.

Given that the manager in question is obviously appalling, I wondered something else. Please ignore me if it's too bonkers.

Did this all kickoff because of the mention of medical morphine? It sounds like some sort of trigger word got said. And I'm wondering if that was it.

Obviously, your manager is.... I mean, I don't have words.... but that makes it even more possible that they've taken a misunderstanding of their own and run away with it.
