On behalf of family member;
their birth mother died when they were a teenager, dad remarried, no further D.C.
Dad died a few years ago and there is no relationship with step mum due to her appalling behaviour when he died.
No will to our knowledge, if she dies does the house go to whomever she chooses or does the child have any rights?

Not an expert in Scottish law, but my understanding is that they had a right to inherit one third of their father's "moveable estate" (i.e. all his assets apart from land or property), but they do not have any claim against their step-mother's estate.

The children have 20 years from their father's death to make a claim against his estate. If they believe they should have received something from their father's estate, they need to consult a lawyer.

There was just his pension and house, step mother never worked or financially contributed.
I shall advise consulting a solicitor. Thank you
