North wales police - PCN turned into £400 fine

Can somebody help me? I’ve been massively shafted by north wales police who claimed they don’t receive my license for endorsement and have now landed me with a £400 fine. I did everything correctly and pleaded guilty with mitigations.

they completely lied and said that they had refunded my original fine. I have screenshots of everything required.

the really annoying part if I was doing 53 in a 50 on average speed cameras so not some dramatic police chase.

where do I go next?

Did you have to physically send your licence to them? I thought that the part for endorsements was all on line. I just had to provide my licence number.

This doesn't make a lot of sense.

North Wales police say they follow the National Police Chiefs' Council guidance on speed tolerance, which means they would not take enforcement action unless you are 10% + 2mph over the speed limit. You should therefore not have faced action unless you were doing at least 57mph in a 50mph limit.

You do not have to send your licence to the police for endorsement. You simply have to give your details (name, date of birth, driving licence number) when they send you a Notice of Intended Prosecution (NIP). The police inform DVLA of any penalty points or other endorsement so it can be added to your record.

If you fail to provided details in response to an NIP, you can be taken to court where you will face a fine of up to £1,000 and 6 points on your licence.

If what you are saying is genuine, I wonder if this is a scam and you haven't actually been dealing with North Wales Police at all.

I sent the details back on time and to the correct address.

They then send me some evidence pack and made me plea. Evidence pack was riddled with errors including getting husbands name wrong and claiming they’d refunded my fine money. And they got the speeding details wrong @prh47bridge - you’re right it was 57 in a 50 - also 50 on a 40 on some paperwork.They’re sloppy at best.

But what has really annoyed me is lying and saying they repaid my fine when they havent.

The police said that they’re refunded me the original pcn fine I paid - this wasn’t true and my bank statements can confirm it. When I sent them an email the day I got the Single Justice Process papers they replied and said they just refunded me. I plead guilty with mitigating circumstances obviously to the speeding but don’t think they ever even read my statement where I point out that I showed compliance and good faith and that I sent the details back and no fine had been refunded.

I have now written to the magistrates court asking for them to appeal and reopen. The entire thing has been completely ridiculous and I’ve now been landed with a huge fine I can’t pay.

Writing to the magistrates court will get you nowhere. There is a form you need to complete and submit within 21 days of the decision. I strongly recommend you consult a solicitor.

Contact your MP for support. If they were to refund you a fine before you pay another, but haven't, it is I reasonable to expect you to pay the £400 before this is done.
