End of fixed term contract renew

Fixed term contract is due to end very soon. The funding for my role has been extended for another two years. However, my employer is refusing to commit to my contract renewing due to a colleague (in the wider company) not having their separate funding extended although their contracts are due to end shortly after mine. They say this is due to possible redundancy to the other colleague who has been there longer than I have. Is this correct?

Not enough information really. How long have you been employed on this fixed term? how long has the other employee been on a fixed term? Are the two posts similar?

10 months for me, two years for him. Very similar roles.

Okay you have no rights because your employment is under two years. The other person has rights if his employment is over two years. It sounds like if the other employee does not get a funding extension, they will allocate your area of work to him and terminate your contract. which they can do.

you don't have possession rights over your area of work or project even if you helped secure the funding.

i would in your position be looking for another job.

If they make him redundant he will be entitled to redundancy pay because he’s been there more than two years, they don’t need to pay you anything for your ten months service so you are “free” to get rid of.

My contract is due to end two months before his is due to end. Can they keep me for those 8 weeks without formally renewing my contract? I assume to then ‘let me go’ so he can fill my place? I do understand they wouldn’t want to pay redundancy, and last in first out.
