Contact with my sons

My sons are in local Lanarkshire Care since 2019 and don't get contact.
My son is with my husband who I separated with I don't get contact with him either. Cumbernauld Social Work supposed to be phoning back. They said I'm not getting contact no Lawyer will act for me.

So if they are in care has there been care proceedings? The son you have who is placed with your ex husband you should be able to go to court for a contact order- if you are on benefits there may be a reduced fee for this.

The first questions would be:

  • why are they in care
  • what are the official reasons for no contact
  • has anything changed since the no contact decision was made
  • can you hand on heart say having contact with you would be in their best interest

That's not entirely true and would depend in part on the reason for removal on the others as well as if he's been placed full time with the dad by ss

OP was the removal and no contact order via the court or as compulsory supervision order via a children's panel hearing?

If the latter the order usually lasts 12 months but you can request a review after 3 months (social Work can bring it back at any point but parents must wait 3 months) and ask for the contact measure to be looked at again. You absolutely can get solicitors for children hearings. I sit as a panel member and have seen lots of parents with solicitors. I also have seen many cases where the panel have considered the social workers recommendations of no contact and ordered supervised contact so it's not a blind following of social workers recommendations

Legally even post adoption you are able to APPLY for contact. There is no legal aid for this but legally you can do so. Whether the OP is successful or not is Down to the courts.

Agree with this post, as I'm also a panel member. If your sons are subject to a Compulsory Supervision Order.
As their mother, you are a Relevant Person. As a Relevant Person you have the right to call a review, receive papers and seek legal representation & possibly be entitled to Legal Aid
