Hit by a car whilst on my bike

I was hit by a car when the driver turned into my cycle lane. I have sustained ligament damage and being investigated for sustained bruising. It happened 7 weeks ago. I have their insurance details. The incident was captured on cctv.
I intend to claim on their insurance. Has anyone got any experience of doing this?

Did you log the incident with the police? That’s the first step. They may want to prosecute the driver for dangerous driving.

I got knocked off my bike from a driver opening his car door on me and got cracked ribs which were very painful and took 6 weeks or so to heal. Yes, the driver's insurance company offered physio and also a settlement. What happened to you sounds worse and yes, do follow up.

I wouldn't bother. It took a few weeks but the insurance company contacted me and then things moved quickly from that point. If you have their details, definitely contact them and see where they are. They won't allow claims until you've been independently assessed, hence why I got the physio.

Wouldn't bother with legal advice? I suppose you think the insurance company are more concerned about paying OP a fair amount instead of keeping the claim as low as possible.

Insurance companies have a cap on what they pay out for particular injuries and accidents and that won't change even if you use a solicitor. The only result would be a percentage cut to the solicitor. Obviously I don't know the extent of the OPs injuries but for me it worked fine to go through the process set by the insurance company. OP: I reported it also to the police and I think this sped it up initially.

Unless you have suffered a measurable financial loss you can't just 'sue' someone.

Claim on your insurance if your bike was damaged, and if you need a new helmet/clothes damaged/unpaid sick leave.

You can, of course, claim for personal injury. That doesn’t require “measurable financial loss” to do.

OP, do you have the insurance details of the car or just the number plate at the moment?

Try Leigh Day - they might do no win no fee. And join either British Cycling, Cycling UK or the LCC as you get 3rd party insurance (in case you damage their car in an accident) and free legal advice (in case they damage you or your bike or kit).

This is wrong information. If a car driver injures a cyclist, so what happened to me and also the OP, it is reported to the driver's insurance company and the insurance company will pay a (capped, depending on the injury) financial settlement. If they damage your bike also, this is an additional cost on top which will be added to the settlement.

Yes, you can and do follow up with the insurance company.
