Friend falsely accused of theft

So my friend applied for a job in a timber merchants which he got. He’s 62 and the employer ideally wanted someone younger and asked if he’d possibly consider working beyond retirement to which he replied he wasn’t sure. He was due to start on Monday but yesterday he got a phone call saying due to a bad reference he couldn’t have the job. Around the same time a local timber merchants went into receivership and so we smelled a rat given that he could cherry pick any of the lads that had just lost their jobs.
My friend phoned his previous employer (he’d worked there for 25 years ) and it turns out he’s never even asked him for a reference and when my friend pushed him on the issue he said “ Well I’ve spoken to someone that says he’s seen you stealing” which is rubbish!!!!
Our suspicions have been confirmed and he’s been interviewing younger people from the timber yard that has gone into receivership… this has to be age discrimination and slander surely???
my good hardworking decent friend is beside himself , not only has he lost a job which he was due to start on Monday he’s also been falsely accused of theft .. his ex boss says he was never asked for a reference and if he had have been he would’ve given him an exemplary one .. can anyone help please ? He’s been stitched up!

That's awful. Would it help your friend to say to him it wouldn't have been nice to work for a nasty liar, so he dodged a bullet?

He was made redundant two months ago with several others from the same company that went into receivership yesterday!

Very true… the guy is a real nasty piece of work, trying everything to worm his way out of it!

I’d 100% go to ACAS, and start tribunal proceedings because it’s about principle. It’s 100% age discrimination.

The employer telling your friend that someone has claimed they saw him stealing is not slander. If there was someone making such a claim that could be slander, but it seems your friend doesn't know who made this statement or even if such a statement was actually made.

It sounds like he may have a case for age discrimination. If he has legal cover on his home insurance, they may be able to help.

I'd have been tempted to counter with "Well, I know someone who's heard you telling shameless lies" and push him for further details on the invented theft.

He's not even a competent enough manager that he would invent a neutral excuse - he's just done the (supposedly) grown-up version of little kids in the playground saying "Well, you smell!"

He would have been a nightmare to work for, but he shouldn't just be allowed to get away with this appalling behaviour.

Thank you … you’re absolutely right … petulant childish behaviour and I think my friends had a lucky escape .. he sounds absolutely crazy!

Get the boss of old company to send a reference saying he never ever stole and the person who said so wasn't senior to your friend and didn't even work alongside him so had no reason to offer a reference. Especially not one falsely accusing theft.

It may not get him the job back but might at least clear his name. It could easily be ageism but to go further you would need solid proof which could be tricky.

Your poor friend. What a horrible situation.
