Advice needed on lending my husband money.

Hi,

please I need advice from solicitors/legal professionals. I bought my home before I got married, my now husband has now moved in. My understanding is that if we separate he will get half - this is fine by me because he pays the mortgage so he’s entitled to it to be fair.

we now have 4 kids and are moving to a bigger place. I have a better job and have been able to save up quite a substantial amount (the deposit and stamp charges will be coming from me) he will be buying this new house in his name only, I won’t go on the documents as we plan to keep the first property and are trying to save on stamp charges. What can I do to make sure that in the future if things go south, I won’t be screwed out of the new home? If we are legally married does that mean I automatically get half anyway? Or do I need to get some paperwork drawn up to protect me? Thank you.

You’re married so you can’t save on stamp charges.

It’s stamp duty and I think if you’re married you’ll still need to pay the additional charge. Please ask your conveyancer - you are worrying for nothing as you will HAVE to pay and they WILL come after you. I’m so surprised you haven’t asked

As per the first poster, you can't get out of paying the higher rate stamp duty if married.

But why didn’t you check with the conveyancer? Surely that’s the first thing to do rather than thinking about “protecting your money”. Very bizarre but nope, loophole well closed. Just pay up or sell your existing property

You are married. The starting point for divorce is 50:50.

You are married, you can't each have a house - the second marital house will attract high rate standards duty.
