Hello,
So last year I got caught with a band A fine due to not realising it had gone down from 40 to 30. I have taken the 3 points:

Ive just recieved an intended prosecution letter for the other day where I was doing 44mph in a 30.

  1. Will this go to court?
  2. I don’t work I am on full disability benefits, UC, DLA, PiP, so how does this work with the fine for weekly income.
  3. I rely on my car for my son who has a blue badge and myself who has a blue badge I cannot lose my car. I know I need to be more careful and don’t need a lecture.

There is a whole Facebook group about this one particular camera, it has only been up a couple weeks and several people have got numerous fines for it. I don’t usually use this road, and it goes straight from a 60 down to a 30. There is no painted lines on the road and the signs are pretty hidden for the camera.

It’ll be a standard £100/3 point fixed penalty, it’s too slow for court unless the OP chooses that option.

Maybe but it could be next stage (band b ) as its higher than 41

Just fill out the form and send it off. We can all say what we think will happen but no one can give you a definite answer.

If you don’t pay attention to your speed / the speed limit then you should not be driving.

Not definitely, I see plenty 44 in a 30 in court and people confused about why they’re in court.

But it’s unlikely and if not a fixed penalty it’ll be dealt with online via single justice. It should be done this way as OP should be getting more than 3 points at this speed.

And PP’s were right, weekly income will be deemed as £120.

It’s a shame tge OP didn’t take tge speed awareness course first time round as she would be more aware when driving and less likely to have been caught a second time. All she’s done is make excuses as to why it ‘isn’t faaaiiirrr’. Also if she now gets minimum another three points on her licence her insurance premiums are going to go up significantly.

These banded fines are only applicable in court. This won’t be going anywhere near court, it’s not fast enough.

That is not guaranteed. The ACPO guidelines are not compulsory, and some police forces do not follow them. If OP is correct that she had a band A fine last year, that suggests that her local police prosecute well below the threshold in the ACPO guidelines.

Three points and an (I think, last time I checked) £100 fine. This won't go to court (bringing the bigger penalties into play) unless you contest it. You weren't going fast enough. There are clear guidelines on this that they hardly ever deviate from.

But (speaking as someone with an imperfect driving record) 44 in a 30 is alarmingly quick. Please slow down.

In that case @Helpandadvice1992 you deserve every point and penny of the fine that you get. Going to court wouldn’t be a bad outcome either. I sincerely hope this makes you stop and think about how you drive and the danger that you currently are behind the wheel.

@Muchtoomuchtodoi didn’t meant for it to sound the way it does. I am normally bery very careful. Last year unfortunately they had just dropped an area I drove a lot of the time from 30mph to 20mph and I was caught doing 27mph. It was pitch black, pouring with rain and I was focusing on watching the road and was an over sight. Around my local town I am very good usually with being at the speed limit as especially following other traffic you stay at a consistent speed. I wasn’t paying much attention to my speed because i know I am normally well within the limit. And majority of the time have had my speed limiter etc on too as a back up. It really was not intentional and I feel awful I was doing 44miles. It was a mistake, I haven’t tried to hide away from it: I accepted it; I haven’t contested it or asked someone else to take it on the chin I have accepted it. This is why I am so worried: today driving I have probably been too slow but that’s because I don’t want to lose my licence

That’s only if it goes to court though. The usual threshold for a FPN, if the force in question are using the NPCC guidelines, is up to and including 49mph in a 30mph limit.
