Redundancy over retirement age

I know this will possibly vary by company but can anyone please advise?

If I’m over legal retirement / pension age, but still working, if my job is made redundant am I still legally entitled to a redundancy package?

No, it does not vary by company. Yes, you are entitled to a statutory redundancy pay.

I'm not sure. I think before legislation was passed you could be forced to retire at state pension age but I don't think you can do that anymore because of the equality laws.

@zipadeedodah What’s retirement got to do with the question? This is about redundancy. So the job is going. Yes, redundancy law applies.

Zipadeedoodah is correct. It used to be that if a job was being made redundant anyone over state retirement age could be forced To retire instead but that was made illegal in 2011.

When giving advice for 2025 it’s always good to give the history/context/actual legislation.

”I don’t think” is not a statement of fact. What you could do 14 years ago doesn’t apply. Children could sweep chimneys years ago. In both cases, the law in 2025 is different. It’s pretty simple really. Someone aged 65 now would be 51 when the faced compulsory retirement at 65. Now they don’t and it’s Jobs that are made redundant. The person can be redeployed if that’s offered. They don’t have to take redundancy pay but it might suit them to do so.
