English conveyancing - F&F form

Following on from my divorce, we are trying to sell the former family home. My ex lives there and I do not have any access to the house. My ex has completed the F&F form, but the solicitor says I need to counter-sign it. If my ex didn't leave the property as described in the form, I would be equally liable for any costs incurred by the buyer. I don't want to sign the form without seeing the property (I haven't been inside in years), my ex won't let me in, the solicitor says he can't progress the sale without it.
I'm not sure what to do about this.
For context my ex is a nasty abusive man who would do almost anything to spite me. I just want to be free of him.

I don't know about the legalities of all this, but if the house is actually on the market the estate agent may be able to arrange a viewing for you without your Ex there. I'm in the middle of selling my house at the moment and our estate agent likes me out of the house when they show people round.

Thanks BrownOwl. I think my ex would need to agree to the agent letting me view, which he probably wouldn't do.

Do you really think he would cause issue to open you BOTH up? And why don’t you have access? Is the house in your name too?
Im not sure you going to the house ensures anything though - he could always remove things after your visit.

SmokyForTheWin · 23/10/2025 16:55

Monday, yes he possibly would. I get the point about him removing things after I've gone. That's another concern, but not one I can really do anything about.
I don't have access because he changed the lock then lied about it in court. He really is a prince among men.

I would sign it and write underneath "I have not lived in the property for x years so am relying on ex DH answers to be true"

Yes I was planning on adding something like that, @saveforthat . I think I'm going to have to sign it. I don't want to lose the buyer.
