Do we just suck this up?

We placed an order for double glazing, paid our deposit, and the survey took place 5 1/2 weeks ago. We were given a lead-in time of 6-8 weeks, so we expected it all to be installed within the next three weeks. We’ve had no contact from the window company until today when they rang to say that there is a problem with the specific finishing we wanted, and that if we still wanted that then it would be a further 8 weeks from today.

Apparently it was “it was all the fault” of the manufacturer, whereas our contention is that our contract was with the window company and therefore it was their fault. We told them that in order to go ahead now we would want a 10% discount off the agreed amount, failing which we were prepared to cancel the contract. The salesman went back to his big boss to see what he said.

Big boss called me back sometime later, and corrected the information given by the salesman, claiming that everything was ready to be installed apart from the French windows. So they could install everything in two weeks apart from the French windows, which would still take 8 weeks. He said that because everything else was ready we could not cancel the contract. Frankly the reasons he gave for there being a problem with the finishing of the French windows could have been any old BS - he had an answer for everything.

Given the two different stories from the windows company, we no longer trust them. Do we have grounds to cancel the contract because the final windows won’t be installed for another 8 weeks (if we are getting the truth this time) or should we just suck it up and think that this is par for the course and the job will get done eventually? Why should we trust them when they have given us two different versions? It smacks of incompetence/poor service, if nothing else.

I think if the Boss has said everything else can be done in 2 weeks, then I'd go with that. Otherwise you've got to start again with another company and further delays, you wouldn't be in a better position. God knows why the first person said the whole order would be delayed by 8 weeks, seems odd. It's a pain that you'll have to wait for the french doors but I don't see what you can do if they have fulfilled the rest of the order. Just don't recommend them to anyone else.

Delays are often part & parcel of transactions with manufacturer’s etc, can’t be helped really.

Thanks for your views. Yes, I would’ve been slightly surprised if everything had been completely on time.

for future reference if you want things to happen according the schedule then make "time of the essence" in the contract.

Thanks - this will help going forward in making sure that they now finalise the job when they say they will.
